Duplicate title deeds commonly occur on vacant or undeveloped land. This is due to individuals working for or outside the National Land Agency, or due to overlapping documents, or because the land has been leased by the owner for too long. This leads the tenant to file a complaint, which is later proven to be inaccurate, fraudulent, or invalid. The research questions raised are: 1. What is the authority of advocates in the mediation process for resolving overlapping land ownership disputes within the jurisdiction of the Denpasar District Court? 2. What are the obstacles faced by advocates in resolving overlapping land ownership within the jurisdiction of the Denpasar District Court? This study uses normative legal research supported by empirical research. The results of the research obtained are that advocates have the legal authority to represent clients in the mediation process, both in and out of court, as regulated in Article 1792 of the Civil Code and Law Number 18 of 2003 concerning Advocates. Advocates often face obstacles such as a lack of good faith from the opposing party, deadlocks in mediation, and low public understanding of the law. This can hinder the effectiveness of the settlement process. Therefore, advocates are required to carry out a broader role, including as a communication bridge between clients and relevant agencies in order to achieve fair and sustainable solutions.
Haryadi, H Nurianto RS, Zuhro Nurindahwati Copyright (c) 2025 Haryadi, H Nurianto RS, Zuhro Nurindahwati https://creativecommons.org/licenses/by-sa/4.0 https://myjournal.or.id/index.php/JSCR/article/view/398 Thu, 17 Jul 2025 00:00:00 +0000 THE AUTHORITY OF THE BRIMOB UNIT OF THE BALI REGIONAL POLICE IN TAKING ACTION AGAINST SUSPECTS OF TERRORISM CRIMINAL ACTS IN THE JURISDICTION OF THE BALI REGIONAL POLICE https://myjournal.or.id/index.php/JSCR/article/view/392
Terrorism is not a new phenomenon, having existed in international politics since the 19th century. This condition results in many cultural heritages that have not been properly inventoried, some have even been lost or recognized by other parties, indicating the weak role of local governments in protecting cultural wealth. This study aims to analyze the effect of employee training, workload, and budget support on cultural heritage management performance through job satisfaction as an intervening variable at the Situbondo Regency Education and Culture Office. The study used a quantitative approach with a population of 410 people and a sample of 103 respondents through a purposive sampling technique. Data analysis used the Structural Equation Modeling Partial Least Square (SEM-PLS) method with the SmartPLS 4.0 application. The results showed that training, workload, and budget support had a significant positive effect on job satisfaction. For the direct effect on management performance, workload and budget support had a significant positive effect, while training did not show a significant direct effect. Job satisfaction was proven to have a significant positive effect on cultural heritage management performance. The indirect effect analysis shows that training and workload have a significant positive indirect effect on management performance through job satisfaction, while budget support has no indirect effect on management performance through job satisfaction. The results of this study conclude that job satisfaction plays an important role as an intervening variable in the relationship between employee training and workload on cultural heritage management performance in Situbondo Regency, while budget support has a more direct effect on management performance.

Vicky Aditya Pratama, Yuniorita Indah H, Muhaimin Dimyati Copyright (c) 2025 Vicky Aditya Pratama, Yuniorita Indah H, Muhaimin Dimyati https://creativecommons.org/licenses/by-sa/4.0 https://myjournal.or.id/index.php/JSCR/article/view/394 Mon, 14 Jul 2025 00:00:00 +0000 POLRI SECURITY INTELLIGENCE IN CONDUCTING SUPERVISION AND CONTROL OF FIREFLOWERS IN THE JURISDICTION OF THE BALI REGIONAL POLICE https://myjournal.or.id/index.php/JSCR/article/view/384
The police aim to realize domestic security which includes maintaining public order and security, one of which is supervision of the circulation of explosives, including sparks. Violations of the law occur when certain legal subjects do not carry out the obligations that should be carried out or violate the rights of other legal subjects. An advocate is a person whose profession is providing legal services, both inside and outside the Court that meets the requirements based on the provisions of the Law. An advocate has the right to assist and provide legal knowledge to the community. The formulation of the problem raised in this study is 1. how is the fulfillment of the right to restitution for child victims of crime in the judicial process in Indonesia? and 2. what is the role of Advocates in legal protection for the fulfillment of the right to restitution for child victims of crime? Where this type of research is Empirical, where in empirical legal research there is a gap between theory and implementation in the field. The results obtained in this study are that children as victims of crime have the right to receive Protection, as well as complete fulfillment of the law, including the right to restitution as a form of compensation borne by the perpetrator. However, in practice, the fulfillment of the right to restitution for child victims still faces various obstacles. And the role of advocates in providing legal protection to children as victims of criminal acts, especially in fulfilling the right to restitution, is very important and strategic.
Kadek Lenny Endrawati, H Nurianto RS, I Made Mulyawan Subawa Copyright (c) 2025 Kadek Lenny Endrawati, H Nurianto RS, I Made Mulyawan Subawa https://creativecommons.org/licenses/by-sa/4.0 https://myjournal.or.id/index.php/JSCR/article/view/385 Tue, 08 Jul 2025 00:00:00 +0000 RESTORATIVE JUSTICE IN THE SETTLEMENT OF CRIMINAL ACTS OF VIOLATION OF THE PRINCIPLE OF PRECAUTION IN BANKING REGULATED IN LAW NUMBER 10 OF 1998 CONCERNING AMENDMENTS TO LAW NUMBER 7 OF 1992 CONCERNING BANKING AT THE BALI REGIONAL POLICE https://myjournal.or.id/index.php/JSCR/article/view/383
Violation of the principle of prudence in banking has the potential to cause economic losses and weaken public trust in the financial system. So far, the repressive settlement approach has not been fully effective in creating substantive justice. This study aims to analyze the application of Restorative Justice by the Bali Police in resolving banking crimes, and to identify the factors underlying its selection. The study uses a normative-empirical method with a regulatory approach, interviews, and analysis of legal practices. The results of the study indicate that Restorative Justice can be applied if the requirements are met, such as the loss has been returned, the victim is willing to reconcile, and there are no elements of serious crimes. This application is supported by internal Polri regulations and local Balinese values that uphold deliberation. Other supporting factors include the efficiency of law enforcement, police discretion, and the role of financial institutions and the community. This study recommends strengthening the policy of implementing Restorative Justice as an alternative to resolving economic crimes that is humane, fair, and effective
I Ketut Wita Darma, Zuhro Nurindahwati, Komang Edy Dharma Saputra Copyright (c) 2025 I Ketut Wita Darma, Zuhro Nurindahwati, Komang Edy Dharma Saputra https://creativecommons.org/licenses/by-sa/4.0 https://myjournal.or.id/index.php/JSCR/article/view/383 Mon, 07 Jul 2025 00:00:00 +0000
